Real estate development requires a team of knowledgeable professionals. As lawyers, our role on the team can range from serving as overall project coordinator to working on discrete documents required for a particular transaction. We work on all sizes of development projects located throughout Florida, with particular emphasis on development being undertaken through public/private partnerships and redevelopment of environmentally impacted property.

During the property acquisition phase, we assist with, or coordinate, land use and real estate due diligence, including but not limited to obtaining zoning confirmation letters, conducting code violation/code compliance research and reviewing environmental reports.

We can also assist in identifying and responding to Requests for Proposals/ Requests for Qualifications from governments seeking private partners for development projects and can assist in identifying and quantifying available public incentives, tax credits and other funding sources for public/private projects.

Once property has been identified, we prepare and negotiate letters of intent and term sheets, real estate purchase and sale contracts, loan documents and leases. We are a title agent for Old Republic, and can provide closing and escrow services for real estate transactions.

Many large scale development projects require significant government approvals. We frequently negotiate and appear before the local, territorial and state government bodies to obtain development orders, zoning and land use changes, permit approvals, variances, and special use approvals associated with development plans. We also regularly assist with obtaining brownfield site rehabilitation agreements and environmental permits required in connection with development.

Anne Pollack

Anne Pollack has been practicing in the areas of land use, real estate, environmental and municipal law since 2000, and she represents clients in connection with all aspects of the real estate development process. She has been involved in countless due diligence investigations and is thoroughly experienced in working with municipal, county and state government staff and officials to obtain a wide range of government approvals, from the smallest variance to the largest master planned development. She reviews and negotiates purchase agreements, use and entitlement agreements, development agreements, and other agreements vital to ensuring a successful real estate transaction, development project and/or governmental approval. Anne also has considerable experience assisting with post-land acquisition / post-approval and post-development matters, including building and environmental permitting, and modifications to approvals.

Tina Fischer

Tina Fischer has practiced land use, real estate and environmental law in Florida since 2005. She represents developers and businesses as outside corporate and real estate counsel. Her experience includes negotiation and drafting for commercial lease transactions, as well as assistance with land acquisition and disposition, due diligence, environmental permitting, and negotiation of land use approvals, master development agreements, interlocal agreements and public/private partnership agreements. Tina is an authorized agent for Old Republic National Title Insurance and frequently acts as title and closing agent for complex commercial real estate purchase and sale and loan closings. Tina provides expert guidance and service through the necessary processes for residential and commercial closings, public/private financing, construction and permanent loans, and other financing.
